DENIED
After taking into account the statements provided in this appeal, I'm electing to deny this appeal. One of the most important things to take into account is Eternity's statement:
In PoliceRP, micspamming is allowed in limited circumstances, and they have their own style when dealing with issues. Here in SCPRP, micspamming is very occasionally tolerated, but typically not. Playing music over your mic is prohibited by the MOTD unless you have ET or SMT approval, which the appellate did not.
The second issue at hand is whether a racial slur inside a song being played counts as racism. As with everything that comes with staff issues, it's a grey area and depends on the context. If a player plays the song once and didn't know that it contained a racial slur, I'd be more inclined to get a verbal and call it good. However, a player knowing it contains the slur playing it repeatedly will get looked on more harshly. Additionally, from a global standpoint, if we allow the micspamming of songs using racial/homophobic/etc slurs, then we'll run into issues of bad actors using soundboards to use these slurs against other players, claiming that it's fine since it's in a song.
It is important to note that staff members absolutely can take into account warnings from other servers. It's ridiculous to think that a player can have dozens of warnings on another server with similar rules and allow them to claim, "well this is my first time here so I don't know the rules". Additionally, it would be even more ridiculous to allow the person that has prior homophobia warnings to claim that they didn't know that these types of slurs are prohibited. The main reasons that I'm electing to uphold the racism ban is because the player knew the song contained explict content, was micspamming without authorization, played the song multiple times, and has a prior history of using slurs.
Thirdly, in terms of staff disrespect, again, it's a gray area. The age of a staff member doesn't matter, only if they can do their job, so referencing someone's age or commenting on the pitch of their voice serves no legitimate purpose outside of trying to get a reaction. I'd say it would warrant a verbal warning unless it was continued after the verbal warning personally, but based on the ban length no time was added, so I'll elect to leave that in place as well.
